L I C E N S E

1. ACCEPTANCE - This is a license agreement between you the end user, 
hereinafter called "user", and Daniel Lewin, hereinafter called "the author", 
governing the installation and use of computer software developed by the 
author and titled WinEye, hereinafter called "the software". Please read the 
terms and conditions of this license agreement carefully before using the 
software. If for any reason you do not agree to all of the terms and conditions 
of this agreement, you are not permitted to install and to use the software. 
By installing, copying, or otherwise using the software, you agree to be bound 
by the terms and conditions of this license.

2. COPYRIGHT - The software is protected by copyright laws and 
international copyright treaties, as well as by other intellectual property laws 
and treaties. The software is licensed, not sold.

3. CONTENT OF THE SOFTWARE - The current version of WinEye contains 
the following files (these files are zipped in Weye30e.exe and will be 
unzipped during installation):
   - WinEye.exe (WinEye program file)
   - WinEye.cnt (online help index file)
   - WinEye.hlp (online help file)
If you got WinEye as a ZIP-arcive this contains additional files:
   - File_Id.diz (short description)
   - License.txt (this file)
   - Readme.txt (short help text)

4. LICENSE TO EVERYONE - You are hereby granted a non-exclusive 
license to use the software for a 14-day evaluation period, to make as many 
exact copies of the software as you wish, to give exact copies of the original 
software to anyone, and to distribute the software in its unmodified form via 
electronic means. You are specifically prohibited from disassembling, or 
decompiling the software or from translating it into another language. You are 
prohibited further from modifying or creating derivative works of the software.

5. LICENSE TO REGISTRATED USERS - If you are a registered user, you are 
granted a non-exclusive license to use one copy of the software on one 
computer by a single user.

6. REGISTRATION - You become a registrated user by sending the correctly 
filled in registration form and paying the registration charge of US $5 or Au-$5 
or Can-$5 or 5DM or 20FF and additional charges for transfer etc. if necessary.

7. DISCLAIMER OF WRRANTY - The software is provided on an "as is" basis. 
No warranty is given or implied by the author in relation to the software or the 
uses to which it may be put by you, the user, or to its merchantability, fitness or 
suitability for any particular purpose or conditions, or that the use of the software 
will not infringe any third party copyright or intellectual property rights.
If the software has any defect that let it become useless, it can be returned and 
the registration fee will be paid back.

8. LIMIT OF LIABILITY - In no event, with the exception of negligence on a 
high degree or intention by the author, shall the author be liable for any loss 
or damages whatsoever or howsoever caused arising directly or indirectly in 
connection with this license, the software, its use or otherwise. 
Notwithstanding the generality of the foregoing, the author expressly excludes 
liability for indirect, special, incidental or consequential loss or damage which 
may arise in respect to the software or from its use, or in respect to other 
equipment or property, or for loss of profit, business, revenue, goodwill or 
anticipated savings.
If any liability can not be lawfully excluded, such liability is limited to the amount 
that the affected party has paid for registration.

9. TERMINATION - This license is terminated if you or the author are found to 
be in breach of any terms, conditions or provisions of this license.

10. LAW - This license is subject to the laws and regulations of the 
Federal Republic of Germany.

11. PLACE OF JURISTICTION - Place of jurisdiction is Darmstadt 
(Federal Republic of Germany).

12. CASE OF LOOSING VALIDITY - In the case of any provisions of this 
license not being legally effective or of losing their legal validity due to some 
subsequent circumstance, or in the case of an omission in this license coming 
to light, the legal validity of the remaining provisions will not be affected. An 
appropriate regulation which comes nearest to fulfilling the intentions of the 
author had he considered the matter in question, is to take the place of the 
ineffective provisions or to fill the gap, insofar as legally possible. If the validity 
of a provision is due to scale of the performance contained therein, then a 
legally permissible scale is to be inserted with due regard to the aforesaid.
